Kennedy’s Own Organization Funding a Lawsuit against Him
When it comes to vaccine safety, the highest officials in public health yield before the pharmaceutical cabal. Even Trump’s Health Secretary Robert F. Kennedy Jr., who spent years warning against the health risks associated with vaccination, is dragging his feet on ensuring vaccine safety. Things have gotten so bad for him lately that the Children’s Health Defense (CHD), the health organization that he founded, is now funding a lawsuit against him.
In May, attorney Ray Flores filed a lawsuit against U.S. Secretary of Health and Human Services (HHS) Robert F. Kennedy Jr. for failing to create a vaccine safety task force. As required by the National Childhood Vaccine Injury Act of 1986, the HHS Secretary is required to set up a task force along with the commissioner of the U.S. Food and Drug Administration (FDA), and the directors of the National Institutes of Health (NIH) and the Centers for Disease Control and Prevention (CDC).
But nearly 40 years later, this requirement remains to be met. No health secretary has bothered to create such a task force and present a report to Congress every two years. The Congress also hasn’t held the HHS accountable for this unfulfilled requirement over the decades. Since RFK Jr. has been idolized by conservatives as the man who would set things straight with timely and effective measures, he has brought disappointment and even anger to many of his supporters. The failure to create a task force has thus provided his critics with the opportunity to hold him accountable to the people.
What wasn’t immediately known about the lawsuit by Flores is its source of funding, which now has turned out to be CHD, founded by RFK Jr., who was a key part of it until he resigned in December 2024 to join Trump’s cabinet. When the news of the lawsuit’s funding broke, CHD confirmed it with a statement on X. The post includes a video statement from Flores, who wondered if this is the same Bobby Kennedy that they knew, adding, “Is he being held captive in the swamp?”
Wyoming Tribune Eagle reported (July 29) that RFK Jr. has asked for more time to respond to the lawsuit and Flores has agreed to allow him until August 15 to respond to it.
Since a lot of conservatives have been upset with RFK Jr. over his failure to pull the dangerous and useless mRNA COVID-19 vaccines from the market altogether, things got worse with the recent full approval of the Moderna mRNA vaccine for COVID-19. The approval, granted by the FDA on July 10, allows the vaccine to be administered to children as young as 6 months and up to the age of 11 years if these children are deemed at an increased risk for COVID-19. The language leaves the decision to the medical system, which has long lost credibility among millions of aware Americans. The FDA approval evoked a strong reaction from independent journalists and the general public.
But RFK Jr. isn’t taking the heat from just one side of the political divide. He left the Democrats pissed by firing all 17 members of the CDC’s Advisory Committee on Immunization Practices (ACIP) in June. The fired members were pro-vaccine individuals serving the interest of the vaccine industry. RFK Jr. replaced them with new panelists of medical experts who have been educating the public about the damage vaccines inflict on health and wellness. Congressional Democrats have now announced a probe into Kennedy Jr’s firing of their favorite panel, leftist news site The Daily Beast reported (July 29):

It was clear as daylight when Bobby caved publicly to pharma’s Shill Cassidy during his hearings. The fact that the 1986 Act, a stain of Reagan admin, wasn’t enforced when it came to the safeguards and accountability tells us everything about who owns this country. Too late to fix it, in my opinion.
WTP: since The Act was about compensation, what safeguards and accountability were you expecting?
Some say it reduced manufacturers liability but the fact is it’s an alternative and individuals are free to launch free-standing cases for any amount of liability they want.
The fact that they were required to report on vaccine safety means there had to be accountability by the government if the proper steps were not taken to ensure a vaccine was safe. The fact they thus escaped any public hearings in case they allowed something bad in the process/product means the public was also not informed on the details.
As for compensation and freedom to sue, that was a punch in the face of the public since the DOJ – the federal government – would defend the vaccine manufacturer/pharma company in the court against the claim. And I have read details of a few such cases. There is no fairness in them and the government literally becomes the bodyguard of its pharma master. The $4 plus billion the program has since paid to victims of vaccines is thus only a tiny fragment of the actual damage because most of the victims are not resourceful or strong enough to win against the government.
WTP: Sorry, long one, you got me thinking… Nice, thanks for the discussion and for bringing up The National Vaccine Injury Compensation Program (VICP or NVICP) that was established by the 1986 National Childhood Vaccine Injury Act (NCVIA). Never knew that one and the more I look, the more I marvel at the genius of it. Representatives Henry Waxman (D) and Edward Madigan (R) were instrumental in drafting and advocating for the legislation for the House. In the Senate, Senator Orrin Hatch (R) marshalled it through. Reagan signed. Oh, those were the days, my friends, how did they ever end?
First, it appears we both agree that tort reform is a loser and that liability suits without bounds are enshrined in America’s psyche and legal system. That’s cool. I think our ability to “sue the bastard” and have juries sometimes send different messages via the reward keeps America great. Some comments on your comments, mostly for definition and clarity.
First, unbounded lawsuits can send a cultural and economic message to all. In the criminal world, the OJ verdict was a ludicrous piece of nullification and a shame to the concept of the rule of law. On the other hand, it sent the message that the LA police had been trampling the rights of people for years. So, OJ the individual gets a break, and OJ the concept of a black man facing LA police wins and the LA police get the message: you must fix this. So, egregious claims and crazy jury decisions can send messages that need to be sent: kind of cool process in that.
There’s two parts in this: the first product testing and approval for safety purposes. That process goes on and has little to do with this bill, the portion you focus on is the compensation portion of it. However, testing is separate and only the results are used in this process to easily specify known issues, with predetermined monetary outcomes from the second part, compensation for injuries.
What the compensation portion does is allow a more efficient and cost-effective way to compensate individuals injured by vaccines while helping to ensure a stable and affordable vaccine supply. You are right, it is a standard payout system like tort reform. You are right, the bill calls for pharma to list potential issues discovered, however, not for safety, but for ease of compensation.
Therefore, you get a list of potential injuries and a table payouts: ez peazy. You don’t need a lawyer, but one is still recommended. It’s a special master I think, again ez peazy.
But here’s some clarification: it is not tort reform, you can choose to use the process OR you can get a lawyer and roll your own for any amount you choose for covering costs, loss, pain and suffering. IOW — you still can sue.
And on this one, another genius part is the government is acting like an insurance company, collecting premiums from excise taxes on the vaccines. So, yes, you are suing the government, but it’s not court, it’s a special master. If you have a lawyer, and you file in good faith, they will cover the lawyer even if you lose. And pharma is not involved, they are covered by the excise tax, so providing data in good faith seems in their best interest. Seems very clever design.
So, let’s look at reality. Covid vaccines come out and they generally test clear with maybe one potential issue making us wait 15 minutes post shot to see if we keel over. BUT — over time, with usage, more things discovered, and they get listed so everyone can see them. Then, pharma is required, by this law, to disclose the list to patients taking the vaccine. Very transparent. Payment schedules are decided by committee, and there it is. There is no way anyone can perfectly test almost anything before rollout in this world. This provides a process to add new info over time, to allow victims to file and get paid quickly and no legal fees. One person here on PBP had a close relative that could apply for this, sadly. It’s real. The covid vaccine is very safe, but inside that, there is always a potential for adverse outcomes. A reasonable risk in this case. Also, if you don’t like the payout, think you deserve more, grab a lawyer and swing away. Sue the bastards. You can. To me, that’s tort reform I can live with. It’s also designed to keep the vaccines rolling and not have pharma get hinky about inventories due to litigation; or worse yet, not to develop new vaccines due to legal risk alone. They are basically taken out of the litigation process. And it’s designed to let you skip all that and sue normally, in court, if you so choose to roll the dice or feel your pain and suffering is more than the master would ever provide.
Another look at reality. A young danger, just out of school, returns to his home town and party’s hearty. Bombed he gets in his bombed neighbor’s new sports car as shot gun and off they go down twisty dirt roads in the rural outskirts of DC. Hitting a sharp bend, the neighbor goes straight, and long-story short — meets large tree, tree wins, concussion, arm is crushed to the point of severed mush of bone above the elbow. Is slightly disabled and will not ever be normal. Gets a lawyer, takes two years by law to reach payout date, no advance legal payment, lawyer gets 33% by law, but pads expenses to get a lot more. More pictures than Alice’s Restaurants. Two years. I was broke, could not work, at first, and no one to help. Gravy, rice, and bread was a comfort meal. Two years out, they call me down to their doctor where I myself with some genius drink a six pack in the parking lot, chew massive amounts of breadth mints, and I can say — the reflex test was really funny. It was my right arm. I am left-handed. We asked for way too much money. They paid in full and my lawyer, a premier DC ambulance chaser, was shocked they didn’t even attempt to deal down his over-the-top payment. I smiled, told him I has broke and he could tip his notary secretary (remember the expenses), and the nest egg became my beginning in investment. Worth $90K in today’s dollars, after the legal fees, but being Frank, without money, without work, I would have taken the fixed fee, no lawyers, pay me now if I could have. In a heartbeat. Two years was very, very tough in the beginning until I could work construction again six weeks of gravy and rice out.
You do not sure the government in court; you get a special master from the court to decide your fate based on “the list” and your submission. While the government was not in court on this, neither was the pharm, it’s a special master you fill out paperwork for. If the master determines you are “acting in good faith,” your legal bills covered, even if you don’t win. However, you are right that the fees are pretty much fixed and one might find them unfair. Part of the goals for this was to protect pharma not for buddy-buddy, or quid-pro-quo, but to make sure pharma kept making vaccines, and kept them in inventory which was sketchy in 1980’s.
Seems like a great alternative to a liability case. Especially since you don’t have to use it in which case you will meet the full force of pharma’s legal team. I suggest beer and Altoids. I gotta tell you, that was freaking funny. HOWEVER, and this is the big one — you never know the future nor what your injury make make happen later. Sure, I got the payout, it was my non-dominate arm, so who cares? Turns out it was a 15% disability, my arm is rotated some and sticks out a bit. Now, my body compensates, my other arm sticks out to match, so I don’t walk in circles. Instead, I walk looking a bit like Popeye’s swagger. I also suffer vertigo in hot showers, an inner ear issue caused by same accident and not discovered until after time period to sue was over. So, I still say —- sue for all you can because you can’t tell all the things in the future that you wish later you could sue for, or worse. You just don’t know.
So, there’s your accountability model, yes, pharma’s off the hook in this government insurance policy funded by vaccine excise taxes except for due diligence in reporting issues to government and patients alike. But payouts are easier and faster with less risk than entering court. Personally, I would not use it if I could avoid it, but that’s me. I would have used it in my example, fer sure. It’s a tort reform hybrid where you can sue directly as an alternative, your choice. I think the public is actually better informed with this model demanding info for the list and to be given to patients, by law. Hiding things is not in their favor, is made worse by this process. I don’t find the evil you do, although I do note that anti-vaxes make those claims all the time. The process does not seem to make those claims true.
I think the model shows genius, seems positive, is an alternative method, not a mandate, is bipartisan, and looks like good work to me. There would be no need to pass this law if the safety was ensured and all was on the level. So yes this had everything to do with it. Note that it specifically applied to vaccines and vaccination because that is what the mandates and recommendations were going to be about in the coming years – not your daily drugs. You could sue the pharma for medication damage and the government won’t fight you there – but not in case of the vaccines. Says it all!
Ease of compensation is a nice spin – in other words, screwing one’s health and admitting that it was the vaccine that caused it but paying out of the taxpayer’s pocket. A mockery of the word fairness!
There is a lot not covered in the 1986 Get People Injured at Taxpayer’s Expense Act – the rule to bar pharma from running its own studies and clinical trials. And since the govt became the pharma’s partner, it would be the same team and a fair trial/test would also exclude the government for conflict of interest. Of course it was – and is – allowed to the point that govt funded the manufacturing process of vaccines at one stage or other. In case of COVID shots, it even had patent sharing – literally slaughtering science and fairness on the slab of profit.
COVID vaccine process was far from transparent. You don’t discover things with time in real science; you run long-term studies to make sure of the safety before granting approval. The opposite was done in COVID shots. Lame attempt to give it a passing grade. And thanks for your self-contradictory “very safe but potential for harm” double-speak. The shots are useless and dangerous while the infection is far less harmful. So entirely needless.

There is no full force of pharma’s legal team once the govt. pulls out of the alliance. That is why the govt. had to come to their defense. Simple and easy.

Good discussion, yet you may be going a bit off the rails now. You have a very dark view of everything and while I believe it’s a “trust but verify” world, hell, I’m from NJ, I do not trust, I do believe we should verify. But for you to assume big pharma is based in Mordor under that all-seeing eye, pretty much says you think my state’s people are all corrupt. And to top is off by saying “bipartisanship” will be our ruination is just weird. A few in NJ are corrupt, most are not. Including big pharma. Or big telecom. Or Campbell’s Soup… It is a business though, and business will always try lobbying, perhaps more, to gain an edge on profit.

Fact is, statistics and quantitative analysis shows the US could have saved hundreds of thousands from death IF naysayers had taken the jab. We have our death statistics, our jab statistics, and same for other countries. OUR response rated us 222 out of like 238 countries. Everyone who participated in the jab at higher rates did better than us, and IF we had jabbed like they did, we might have come in at 100, instead of 222, and thus —- all those folks would have not been killed by covid.
Yes, I do not understand the entire bill and yes, the bill goes way beyond vaccine compensation which is only a portion of said bill. But the government is not fighting citizens on behalf of big pharma. You cannot prove that they do. This compensation changes NOTHING over the model you and I both like: the unbridled liability suit. The thresholds are set by law, but you will always learn more post release from the real world. There is no way to test every single possible situation, variable, and demographic. It’s just impossible.
I was a product guy: hardware, software, and more. I built my teams to test, but more importantly to respond. In today’s world, there was no way to test everything, every environment, every possible variable that might affect my product. There was always limited time and resource – that’s life. So we aimed for the high points, tested as well as possible but made sure our rapid response was ready, willing, and able to jump on any new wrinkle that popped, usually an interaction with some other product. Twas not the 99% of issues that got us, it was the 1% at the edges where new issues would arise that ONLY could be found in general availability and no way would be found UNLESS your test looked like general availability. Just the way it is. Same with medicine where instead of 99%; they probably get to like 99.9%. But shit happens and it’s great that this process is built to cover that, not hide it. Pharma does not fear the monetary loss, has no reason beyond perception to hide it, and IF they hide it, get caught, given the process — that’s even worse than not having the process.

And who was the top cheerleader for speed? Trump, right? Fact is — it worked and the COVID vaccine is very, very safe. Of course, there are side effects and the possibility of them. Of course, some issues were found after general availability. More data is good. As is with all vaccines, all medicines, even OTC crap. That’s life.
