Documents report reveals Biden’s mental condition

The Report by Special Counsel Robert Hur stirred two controversies.  The first raises the question as to why he did not recommend an indictment of Biden for the illegal possession and handling of classified government documents – especially in view of all the condemning details that were revealed.  The second was the report on Biden’s mental acuity.

Hur has succeeded at making both political camps unhappy.  Republicans see the lack of prosecution as a double legal standard – especially in view of all the examples of incriminating behavior.  While Team Biden is happy to be exonerated, they are enraged at the references to Biden’s age and mental acuity.

Hur seemed to see two factors that led him to use his prosecutorial discretion to not pursue an indictment – Trump’s case was worse, and Biden is too old and too compromised to be convicted by a jury.  The problem is that both of those considerations are secondary to the evidence that Hur laid out against Biden – and essentially ignored.  The Report looks more like prosecutorial INdescretion.  Hur appears to have allowed the Trump case and Biden’s mental condition trump the evidence.

While Biden proclaimed his total innocence, he was not a happy camper about the Report.  He did not like the statements suggesting he “willingly” took and retained the documents – and fibbed about it.  Two issues that were noted in the indictment of Trump.

Biden especially did not like the references to his mental acuity – or lack thereof.  In an angry rare press conference, Biden insisted his memory was fine. In what had to be an embarrassment in view of the topic of the press conference, Biden mistakenly referred to the president of Egypt as the president of Mexico – who he said he talked on a frequent basis. 

Even though the Report took him off the hook, Biden saw it as a political hack job – obviously forgetting that he was being investigated and exonerated by HIS own Department of Justice – by a special counsel appointed by Attorney General Merrick Garland. 

It is important to understand that the observations in the Report were not the opinion of one person.  In every interview, there were a number of people involved on both sides.   Hur did not reveal anything that was not observed by others – and reported in transcripts and likely recordings.

There are reports that the White House is considering the release of transcripts.  They did not mention recordings.  Transcripts will not capture senior moments, memory pauses, etc.  If there was not a problem, the White House would demand the release of the tapes.

What is so damning about the Report is that it reveals Biden in an uncontrolled and unscripted situation.  And the examples were not some minor incidents that are commonly forgotten.  The report read that “He did not remember when he was Vice President.”  He also “did not remember, within several years, when his son Beau died.”  Those lapses are more indicative of senior moments.

Hur had to provide specifics on Biden’s age and mental acuity since that was one of the major considerations for not recommending an indictment.  He was concerned that he would not get a conviction because a jury would be sympathetic to “an elderly man with a poor memory.”  By most prosecutorial standards, that is not a reason to reject prosecution, but it is the one Hur used and is obligated to explain.

The Biden defense team has gone into action with the most hyperbolic counter arguments.  They claim that Biden was under stress when interviewed because of a crisis in the Middle East.  That may not be the best excuse.  It could be seen as an admission that Biden cannot handle the stresses of the presidency – in which multiple crises are common. 

Vice President Harris has been on virtually every news outlet, Democrat Congressman Dan Goldman on CNN, Democrat operative Adrienne Elrod on MSNBC and others took to the airwaves to offer extreme, and incredible, counter arguments.  They were contending that Biden has amazing energy and an extraordinarily good memory.  They spun Biden’s cranky old man performance as an indication of vitality.

Since the pitch by Harris, Goldman and Elrod is so out of line with what the public sees and believes, it is unlikely they will be effective in convincing that 70 percent of the public who say that Biden is too old and too impaired to serve another four years as President.

Both Goldman and Elrod assured the audience that once we see Biden out in public interacting with the voters, we will see a man fully able to carry out the responsibilities of the presidency.  There is only one big problem.  The people are never going to see Biden out among the people, pressing the flesh and offering impromptu comments.  He will be restricted to a few insulated and carefully scripted events, with very few questions from the people or the press.  That was the strategy during the Covid Pandemic – and even more so since Covid no longer provides an excuse.  At this time in his presidency, President Obama held more than 300 press conferences.  Biden has held 80.

Biden’s problem is that all the political cheerleading from the sidelines is not going to influence the already formed opinions of voters based on what they observe.  The Hur Report will heighten those concerns.

Footnote: Hur’s reference to Biden’s failing to recall when he served as Vice President brought back one of my occasional dinner conversations with former Defense Secretary Casper Weinberger – a close personal friend of President Reagan.  Weinberger was passing through Chicago after what turned out to be his last visit with Reagan.  When I inquired how the former President was doing, Weinberger leaned forward and said, “He has no recollection of ever having been President.”  Mental decline is a sad reality.

    Well there is another reason all this could be taking place. Hur, Merrick Garland, all the Clowns dealing with Biden
    have a lower mental acuity than the President.
    Maybe their memory is intact, but can not comprehend what they are seeing.
    This whole administration is definitely made up of Democrat’s.

    Okay, I held off commenting until I heard the Trump verdict today on his civil fraud case.

    So here is the way this Independent / unaffiliated voter looks at this mess:

    So this article attempts to make the case that Biden has insufficient cognition to execute the LAWFUL duties of the POTUS. While I agree with the article that Biden’s cognition does appear to be slipping, there are many duties of the POTUS that are not affected by small slips in cognition. And the POTUS has an executive council called the cabinet, and many high powered advisors that advises him daily and that he can call anytime he wants.

    Now comes Trump and the $354M judgement against Trump that includes a three year ban on Trump being an executive of or doing business within New York. The court in New York has basically given a ruling that Trump is not qualified to be a corporate executive in NY due to repeated uncorrected violations of NY law.

    So if the State of NY does not think Trump is qualified to be a CEO of a company, how is it that GOP’ers feel that he can be a CEO of a country with the most powerful military???

    Again, the GOP is proving to be a disaster for the country on border issues, abortion issues, and now on Executive Management issues! Good luck MAGA folks, the election is already slipping through your hands with this narcissist that has a full schedule of legal appeals for civil and criminal cases. I question how such a racist narcissistic man with all of this baggage (and he makes Hillary look like Little Red Ridinghood) can Make America Great Again??!!! He appears to be heading his life into the sewer! And since most MAGA folks are “Christians”, Jesus says, “A tree is known by its fruit!” Take an honest look at the fruits of Trump! Vote for Haley, rid yourselves of Trump, and make America great again with a candidate that does not have dementia, does not have all of these legal losses and appeals, and DOES have world and state government experience!!!

    At this point, I believe the POTUS and SENATE would be best controlled by the Dems, and the budgets and legislature is best controlled by the GOPs. Haley would change my and most Independents views.

      Tom … I tend to agree that Biden may be able to get by TODAY, but given his condition, I am personally convinced he cannot go 5 more years…and that has to play into my vote. Several years of a failing President followed by President Harris is a frightful thought. And who would be running the country as Biden slipped?

        I think about that all the time Larry. When I listen to the outrageous things coming out of Trump’s mouth, (which we now know he means) I become more fearful for the world, fearful for our alliances, and willing to let whoever is Biden’s VP do whatever they can but under the heavy thumb of congressional control by the other party.

        And I keep praying that Haley can pull off a miracle.

    Tom, he’s not criminally guilty, just liable which is better. Plus, he’s really not liable, he’s under appeal which is less liable. Plus, it wasn’t just him, Eric and Don Jr. are liable too proving everyone does it so it’s ok. They got hit for 4m each and two years no can do business in NY.

    Biden did it too. Biden is guilty as hell says Republicans listening to their dozers of whistleblowers which means a couple of which one is just indicted for lying about it. Proof Biden does it just like Don. Who needs court when you got Gym-daddy Jordan and Commie Comer.

    Guilty or not, Don will pay very soon even while on appeal. And that’s just fucking priceless my friends. Priceless. The emperor has no clothes nor cash to buy some.

      The court cases are designed to harm Trump. No way would all of these laws have been broken over the years without someone being held accountable a long time ago. Tom said that the election is slipping through the republicans fingers. Could be but I swear on the Father, Son and Holy Ghost that I will never comply with democrats. And I’m doing all that I can to persuade the patriots everywhere to join me. But the votes ain’t counted yet. Just don’t steal this election. Or else!!!!! What will happen?? Stay tuned and find out.         Trump was held liable about the last time you voted him for defrauding his Trump University students as a cheating businessman.

        Trump defrauded his own foundation stealing from the less fortunate and taking the tax break for it on top. Swell guy, real patriot just like HB.

        Then, many years ago, he was held liable for getting Carroll alone, slamming her against the wall and pinning her, reaching up under her skirt to pull down her tights, then he reached under her panties and shoved his fingers into her vaginas for his gratification. And there were a number of other women who testified, under threat of perjury, that Trump did similar crap to them. Trump was too afraid to testify. There were no countersuits to the other women. Trump countersued Carroll on her declaring him a rapist for defamation. He lost as the judge announced: you are a digital rapist and would be found guilty of rape anywhere but NYS where a penis is required. Thus, it sounds like Trump was adjudicated to be dickless too.

        Recently, his business was found to be guilty of criminal crimes in tax fraud and cheating. Not a criminal enterprise, but an enterprise that takes criminal actions for profit. Cheating to make a buck.

        On March 24, jury selection starts for Trump’s NY criminal trial where he is already named unindicted co-conspirator number 1 and his partner, Cohen, already went to jail for the crime. Trump looks to be toast, there is jail time involved. Worse yet, when Cohen got out on a covid risk, Cohen was about to release a tell-all book so Trump arranged to weaponize the DOJ through Barr and they put Cohen under a gag order and back in jail. Sweet, loyal guys.

        And DC, Florida, and Georgia are still designed to harm Trump muchly over his attempt to rig the 2020 election.

        So, HB, our plucky patriot —- what are you waiting for? Through Trump you seem to be complying to the law ever day and twice on Sunday. Pretty sure there are a lot of Democrats bending Trump to the will of the law; you even say they are weaponizing. If you are a good Trumplicant and are donating to the cause, then you are already spending your money in compliance in the same court you say is a Democratic Trump unconstitutional vendetta. As to the election, you didn’t find anything last time, Republicans riots, over 1,000 arrested with still more to come and over 400 with jail time I think, or thereabouts. So, bring it on, son. Bring it on.

            I say it’s game on because Trump must pay over half a billion in fines and interest, he can’t do business in NY for three years, his kids got fined four million each, they can’t do business in NY either. And now he is caught facing criminal charges next with jury selection at the end of March where he is already unindicted co-conspirator number one and his fellow conspirator already did jail time. With two more criminal trials after that, one of which his lawyers have already pled guilty. Yeah, its game on to show you what you voted for and can vote for again.

        Well much of what we comply to in our private lives are laws. I hope you will make the right decision and stay out of harms way and jail. With regard to staunch GOP Trump supporters, at what point do you start listening to what he is saying and conclude what he wants is harmful to the country, and our alliances around the world. At what point do you say, “Wow, we will have a big hole to dig ourselves out of!”

        I think we are at the point where even if Biden cannot make it through a second term, his successor VP with heavy congressional oversight will do less damage that we have to dig ourselves out of. Time will tell. Electing Haley would sidestep all of this.

      Yes it may be down to his personal life and shady business practices that end up stopping him. I don’t know. The next three months are going to be very interesting. I do not think the founders ever envisioned a situation where the electorate elects someone to run for president who may also end up in prison.
