Trump’s reason for leaving Abrego Garcia in El Salvador is not what you see on the news
The case of Kilmar Abrego Garcia is getting a lot of attention. As expected, Democrats and the left-leaning news media are laying it on thick. The narrative is that Trump has illegally seized an innocent family man yearning to breathe free in the land of opportunity. He has been snatched up by Immigration and Customs Enforcement and shipped off to a foreign land without due process. That is not exactly the real story.
The advocates for Abrego Garcia note that he has never been convicted of a crime in the United States – although he did commit one entering the United States. That is an irrelevant argument. One does not need to be convicted or even indicted of a crime to be deported. A person can be viewed as undesirable for many reasons — and deported at the discretion of the government.
Abrego Garcia is an illegal alien who has been ordered out of the country by courts. There has been evidence and testimony that he was associated with MS13. He was picked up by Prince George’s County, Maryland police in 2019 in the company of MS13 gang members. In his hoodie, he had “rolls of money” in which the eyes, ears and mouths of the presidents were either covered or erased.
According to an online article by NBC News:
“The officers said such insignia — indicating ‘ver, oir, y callar’ or ‘see no evil, hear no evil and say no evil’ — was ‘indicative of the Hispanic gang culture.’ The officers said they consulted with a reliable confidential source, who advised that [Abrego Garcia] is the rank of ‘Chequeo’ with the moniker of ‘Chele’” in the gang.”
Abrego Garcia was arrested for domestic violence, but no charges were brought. He has also been accused of human trafficking, but no evidence has been made public so far. That is due to the fact that they cannot bring an informant into court – thus revealing methods and sources
Abrego Garcia appeared before an immigration judge in 2019, who determined that he was, in fact, associated with MS13. That decision was upheld by the Board of Immigration Appeals later that year — dismissing Abrego Garcia’s challenge to the judge’s factual findings. (When the Abrego Garcia fan club says there has been no due process, they are …. fibbing).
The immigration courts made Abrego Garcia eligible for immediate deportation. Later that year, an immigration judge ruled that Abrego Garcia cannot be deported to El Salvador out of his claim of mortal fear – even though he is an El Salvadorian citizen.
Due to an admitted effort, Abrego Garcia was deported to El Salvador. The federal courts have ordered his return. The Supreme Court – in a vague ruling – said that the Trump administration should “facilitate” his return.
At this point, the United States has no authority to order El Salvador to return Abrego Garcia – and El Salvadorian President Nayib Bukele has said he has no intention of doing so. That leaves open the question as to whether the Trump administration has the leverage and influence to get Abrego Garcia back.
If Trump could get Abrego Garcia returned, why not do that and then immediately deport him to a different country – which would be perfectly legal? That seems an easy way to resolve the entire issue.

The fate of Abrego Garcia is not the primary issue for the Trump administration in these court cases. The most important issue from the standpoint of the White House is presidential powers and the authority of federal district judges. There are two issues. Do district federal judges have authority over certain presidential actions? And can a district judge apply decision over the entire nation?
The Trump administration is arguing that a single federal district judge does not have the authority to issue orders on a national basis or to undermine a president’s authority on a range of issues – including immigration. Trump’s position is that it is not right for just one of the 677 federal district judges to be able to set the rules for the entire nation. It has been the case in the past – and sometimes different federal judges from different districts have issued opposite rulings on the same issue.
Some members of the Trump administration have hinted that the reason Trump is resisting local federal judges’ orders to get Abrego Garcia out of El Salvador is because he does not want to set a precedent of obeying orders that he believes are an abuse of judicial power. Trump is building a case for the Supreme Court, where he hopes that the high court will rule in his favor and declare that only the Supreme Court can address presidential powers on a national level.
The Supreme Court has fulfilled its role in ruling that presidents have abused their power in the past. It happened with President Biden’s initial school loan forgiveness orders were declared an abuse of power by the Court.
In many ways, the Abrego Garcia issue is merely a sideshow to the larger issue. It is not likely that the Abrego Garcia case will be settled until the issue of federal district judges’ power reaches the Supreme Court. In the meantime, Abrego Garcia will either remain in El Salvador or be laterally deported to an alternative nation. He is not likely to be returning to America.

FOOTNOTE: Maryland Democrat Senator Chris Van Hollen traveling to El Salvador to play “patty cake” with Abrego Garcia was outrageous and an amazing example of political malpractice. He again puts Democrats on the wrong side of the immigration issue. They allowed millions to flood into the United States – including vicious criminals – and now they are doing everything they can to prevent them from being deported.
Larry callously overlooks the rule of law in this and determines the word of police officers, one who was fired for misconduct, is good enough to seal this man’s fate. Insinuations, accusations, but not evidence have doomed this innocent. Innocent before proven guilty, remember? Larry says the man is not the issue, I guess people do not matter to him against the power of his policies to have Trump stand above the courts. No due process; we are treating them as foreign combatants not even worthy of a military tribunal, much less citizen rights, as we send them to their doom chained, shackled, and hobbled. Even Guantanamo, albeit trapesing on the edges of the Constitution, was better given they were true combatants and Guantanamo is basically US soil. Guantanamo has habeas corpus and military tribunals. This is not even that. There is no habeas corpus, there is no court, there is no tribunal even. This is people, some blatantly innocent, disappeared in the dead of night to never be heard from again. Larry loves the proces. Have no doubt, they will die in that gulag. Larry loves the process.

The U.S. Constitution’s Article I, Section 9, Clause 2 guarantees the right to habeas corpus, stating it cannot be suspended unless in cases of rebellion or invasion where the public safety may require it. So Trump sends him to El Salvador (some in the regime say mistake, others say deliberate, I suspect the later is the truth). The Supreme Court is the Court that Trump is defying, since you appear to not recognize that ruling, we have to assume you are lying (or do you really want to admit to being so stupid as to not understand what the court ruled that “the administration should facilitate his return”.
