Trump Fights Subpoena Will Never Testify Before Jan. 6 Committee

Even as he has announced his intention to take another run at the White House, as expected, Donald Trump is fighting the subpoena from the January 6 committee. Trump’s lawsuit means he is unlikely to ever testify before the one-sided committee, which will likely be disbanded should the GOP take the House, as it appears they will.

Trump’s attorney David A. Warrington said in a statement that the ex-president “engaged with the Committee in a good faith effort” to resolve his concerns around executive privilege.

“This partisan Committee insists on pursuing a political path, leaving President Trump with no choice but to involve the third branch, the judicial branch, in this dispute between the executive and legislative branches,” Warrington said.

In a 41-page complaint, Trump’s lawyers argued a former president can’t be compelled to testify before Congress.

The lawsuit also draws on a long-held Republican case that the committee is illegitimate and lacks the authority to issue valid subpoenas.

In response to the lawsuit filed by Trump to block the subpoena from the panel for documents and testimony, the panel said that it is “evaluating all of its options.” 

“Former President Trump has failed to comply with the Select Committee’s subpoena requiring him to appear for a deposition today,” the committee chair, Mississippi Rep. Bennie Thompson, and Wyoming Rep. Liz Cheney, the vice chair, said in a statement on November 11.

“Even though the former President initially suggested that he would testify before the committee, he has since filed a lawsuit asking the courts to protect him from giving testimony,” Thompson and Cheney said.

But Trump’s attorneys have a different take on the situation. 

In their lawsuit, his lawyers argued that Trump has retained immunity as a former president and that while other presidents and former presidents have voluntarily agreed to testify before Congress, his legal team claimed that no president has ever been compelled to do so.

They described the committee subpoena as “invalid” because they said it did not further a legislative purpose and claimed it was overly broad and infringed on his First Amendment rights.

The Jan. 6 committee had extended the deadline for Trump to comply with their documents request by one week. The initial deadline was Nov. 4.

    Sure, the committee is toast in January. The DOJ lives until 2025, at minimum. All the participants will be punished, many will languish in jail for believing Trump. Trump hasn’t helped them, he hasn’t covered any legal fees, he is just trying to save his own pussy ass.

    Trump may be punished still at both the Federal and State levels; this will continue until you take the Presidency, and may continue afterwards unless you, once again, politicize the DOJ as Trump did.

    The rats are jumping ship, many have turned on him already, it is not 2020; it’s 2022 —– Biden Time!!!

    Suck it up buttercup, he is going down, his party (except people like Larry Horist) are quickly turning against him publicly, even FOX dumped on the candidacy announcement. And he probably will never testify. He can’t, he’s a pussy. Cheney wins by standing up where people like Larry sat down.

    Looking back, if you had impeached this turd, your party wouldn’t be in this mess, top secret documents probably wouldn’t be at Mar A Loser, and we wouldn’t have to relive this guy’s lies one more time.

        First, Trump offered to testify if it was aired on National TV, Democrats refused, why, they aired all of the supposed witnesses. Moreover, those witnesses were caught in lie after lie. You don’t have to like a person, but at least be truthful about what you say.

        Agreed! Blind loyalty is never good except when it is loyalty to God, not man. I do disagree with Pence’s statement that he will not testify because “of separation of powers”. If Lady Justice is truly blind, she should not see any separations of power when it comes to seeking truth! I hope you, me and Larry can agree on this! I also have IBS over the DOJ decision not to indict Trump now if what the DOJ says is true when they say that they have enough evidence for at least one indictment but Biden seems to be holding them off. I need to run to the store for more Imodium now!!!

Most Independents feel the same way! However, more points could have been earned by limiting the overuse of the word, “pussy”, and, Larry has often spoken against Trump (although it was mostly Trump’s personality, not his policy) and he has strongly criticized the 1/06 committee as contrived and illegitimate which is a view not shared by many Independents/unaffiliated voters.

    A person does not have to be guilty of anything in order to invoke the Fifth Amendment protections if they know their testimony will be twisted and used against them. Mr. Trump should have gone before the Committee, and then declared that he knew his words would be twisted, and thereby would use the Fifth Amendment to protect himself. Unless the Committee offered some assurances that they would not misconstrue his statements, it would be a legal and valid decision.
