In the wake of the horrific, brutal murder of a twelve-year-old girl last week, incensed Texas lawmakers are seeking stronger restrictions on “catch and release.”
Family members of the Houston girl who police say was killed by two Venezuelan men who entered the U.S. illegally said that they are supporting legislation that would severely limit the ability of federal immigration authorities to release immigrants they detain. The proposed legislation runs counter to what migrants’ rights groups advocate — a move away from detention — with one such advocate calling the measure an effort “to bloat the immigration enforcement system” and “to demonize immigrant communities.”
Venezuelan nationals Johan Jose Martinez-Rangel, 22, and Franklin Jose Peña Ramos, 26, have been charged with capital murder in the death of Jocelyn Nungaray, whose body was found in a creek on June 17 after she disappeared during a walk to a convenience store. A medical examiner concluded that she was strangled.
The two men entered the United States illegally earlier this year on separate occasions near El Paso. They were arrested by the U.S. Border Patrol but later released with orders to appear in court at a later date, according to the U.S. Department of Immigration and Customs Enforcement, or ICE.
Their release came through ICE’s Alternatives to Detention programs, which allow detained immigrants to be freed while their immigration cases are pending. ICE uses GPS monitoring, phone calls, and a phone app to monitor them and ensure that they make their court appearances.
“The two men who ripped my daughter away from me should have never been here. They should never have been roaming our streets freely, as freely as they were,” Alexis Nungaray, Jocelyn Nungaray’s mother, said at a news conference.
Following the girl’s death, U.S. Sen. Ted Cruz and U.S. Rep. Troy Nehls, both Republicans from Texas, introduced legislation called the “Justice for Jocelyn Act.” It would prevent federal authorities from releasing a detained immigrant if there are open beds available at a detention center.
If detained immigrants are released, they would be subject to continuous GPS monitoring and have a nightly curfew, and any violation of the terms of their release would result in immediate deportation.
“These are crimes committed by illegal immigrants who were apprehended and that the Biden-Harris administration chose to release,” Cruz said.
Jocelyn’s brutal death at the hands of these two barbaric migrants is just another example of the Biden-Harris failed immigration policies. In Georgia, the arrest of a Venezuelan man accused of killing nursing student Laken Hope Riley became a flashpoint in the national debate over immigration. Such acts are on the rise. In addition to the horrific slaying of 12-year-old Jocelyn, a Virginia grandmother was killed last week during a carjacking by two illegal migrants from El Salvador.
While crimes like these have caused Texas lawmakers to propose some much overdue new legislation on ICE’s “catch and release” policies, this recent rise in migrant crime should emphasize the need for the United States to protect its citizens by exercising existing deportation and detention requirements embodied in the Immigration and Nationality Act.
The BREAKDOWN that allowed this to happen needs to be investigated, analyzed and SHUT DOWN.
ICE’s Alternatives to Detention programs, which is still running I think, needs to be SHUT DOWN during the investigation and not opened again until cleared of anything like this occurring again.
The Texas Lawmaker’s bill is reactionary, might as well pass, but we need a root cause as to whether ICE’s Alternatives to Detention programs can ever be used at all.
This was a terrible BREAKDOWN that cannot stand.

I agree Frank. The Japanese say “Ask five whys and you will be at root cause.”. The problem is you can ask five whys but that needs to be followed up with action. And this is the problem. I think they know the root cause(s) of how this is happening but without the funding that would have come with the border bill there is not much that can be done. Again, it seems like many of these immigrants are “gotaways”, or “catch and release”, etc. It all points to lack of resources, capacity, and systems to do a proper job of vetting.
And then there are other problems. A friend of mine working in AZ on this issue said it is hypocrisy on a grand scale in AZ. He says, ” Dems want to build their base, GOPs want the cheap labor so they are willing to let each other have their way.” E-verify and mandatory living wage would stop this root cause.
The way I as an independent see this is the GOP/Trump killed a bill that maybe would have not shut the border (GOP killing basis complaint) but it would have limited the border and most importantly it would have given resources to start addressing these root causes. I am also in favor of establishing a very large scale processing center that all of them area automatically shipped to in some lovely town like Nome, Alaska! And the E-verify that we both have suggested is another good idea.
thanks Tom. Yes e-verify is a tested and workable solution. Like hacking, there will be issues, there will be fixes, but so far, the biggest issue is creating illegal-free islands surrounded by illegals working. That causes a myriad of problems similar to our “gun control islands.” Nationwide fixes it. Also, as loopholes are found, they get posted and become used a lot, overnight. This we tamp down one at a time and as illegals leave for lack of work —– it will lessen.
I don’t want to say it, but also, IMO, no facts, IF suddenly all illegals are fired, have no money, need to survive, we could have an uptick in crimes of necessity or worse. Not a given, but if it works as well as expected, we may need to provide free bus rides home.

Maybe the Fed can start a program. Call it “Give an Illegal a ride”. Make it tax deductible as a donation. Let all that want, sponsor a ride back home as a tax deduction. I would donate. And I would use school buses, not motor coaches. No A/C. No conveniences beyond water. Armed guards on every bus with orders to defend themselves. Caged drivers that can not be accessed accept by key held by the driver. And Kamala can teach them one of our favorite national songs, “The Wheels on the Bus Go Round and Round – ALL THE WAY BACK HOME!!” lol
Damn, Tom, in 86 I was sent to Toshiba, our partner in Japan, to learn their R&D and production secrets of success, ie best practices. They were previously my consulting client so I sort of went in deep cover not wanting to disclose that OR meet those VPs. I was always impressed by their technical expertise and my project with them moved market share enough to keep them as client for life.

FYI — what I did find was telling. Much outsourcing to clear their factory of “clutter.” And much “clutter” literally behind the curtain they installed to hide it from visitors. Yes they came up with the 5 whys technique which was originally developed by Sakichi Toyoda who stated that “by repeating why five times, the nature of the problem as well as its solution becomes clear.” The five whys are used for drilling down into a problem and the five hows are used to develop the details of a solution to a problem. This 5 whys approach to root cause analysis dovetailed naturally into Edward Demming’s work. I went to one of his seminars. Check the internet and you will find there is much on it, including charts and all. Its a very popular technique.

Actually, 1) Eggs indeed must be broken to make an omlet. This is true. 2) The two young men violators are not citizens and do not vote. Nobody crossing the border illegally can vote. Even with an asylum green card they cannot vote. 3) Remember it is the GOP that killed the border bill that would have provided resources to combat these border problems – Trump does not mind a few citizens being killed if it helps him get elected and avoid jail on multiple cases, with one sentence being handed down on Sept 18th. Other cases are moving forward.

Tom, not quite. They are not citizens so the Constitution applies at that level. IE — they do not get the full rights in the Bill of Rights.

But to your point Frank, the right to vote in national elections and the right to not be subjected to unreasonable search (especially searches at the border) do not apply to illegal immigrants. Boarder searches have been deemed by the courts to be legal.

IF you look at the actual numbers, actually it appears that Trump rode on Obama’s results for 2017 and probably 2018. And in 2019, he racked up the highest border crossings since 2007. That’s not a stellar recommendation for his policies. Plus, he failed to stop covid from crossing the boarder, fell asleep at the wheel, froze like a deer in the headlights and we lost over 1.1 million while significantly reducing our expected lifespan. Actually Frank and Darren, I am not convinced he was shot. Trump has silenced the emergency room from releasing any details of his time in the ER. And when I looked at a close up of his ear recently, I think it was during the Nevada campaign stop, his ear was incredibly normal looking and looking like his other. It didn’t look like anything hit it. A bullet would have ripped it and it most likely would have been visible after healing. So at this point, I cannot say he was shot.
All I can say is that we have a tape that details a shot being fired. We see something red on Trump’s ear. We she SS trying to protect him and pushing him down. We see Trump defying SS orders to stay down. That is it.
