In the wake of JD Vance’s decisive victory in the Vice Presidential debate, Biden DOJ lackey Jack Smith tries to derail Trump’s run for the White House.

The desperate move by the Dems comes with only about month to election day, this despite the traditional rule where the DOJ will not release anything that could damage a campaign within 30 days prior to a presidential election.  

Smith’s newly unsealed court filing claims President Donald Trump “resorted to crimes” and argues that he is not entitled to immunity from prosecution. The filing was submitted by special counsel Jack Smith’s team following a Supreme Court opinion that conferred broad immunity on former presidents and narrowed the scope of the prosecution.

U.S. District Judge for the District of Columbia Tanya Chutkan unsealed Smith’s lengthy filing after the special counsel submitted the document, in which he lays out the case and alleged evidence he intends to use in an eventual trial against Trump.

Trump pleaded not guilty to all charges brought against him by Smith.

Earlier this year, the Supreme Court ruled that a president is immune to prosecution for official acts.

Smith was then required to file another indictment against Trump, revising the charges in an effort to navigate the Supreme Court ruling. The new indictment kept the prior criminal charges but narrowed and reframed allegations against Trump after the high court’s ruling that gave broad immunity to former presidents. 

In the unsealed filing, Smith outlines a “factual proffer,” alleging that Trump “resorted to crimes to try to stay in office” after losing the 2020 presidential election.

“With private co-conspirators, the defendant launched a series of increasingly desperate plans to overturn the legitimate election results in seven states that he had lost—Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania, and Wisconsin,” Smith wrote. 

The 165-page filing goes on to say that the “throughline of these efforts was deceit,” claiming Trump and co-conspirators engaged in a conspiracy to interfere with the federal government function by which the nation collects and counts election results, which is set forth in the Constitution and the Electoral Count Act (ECA); a conspiracy to obstruct the official proceeding in which Congress certifies the legitimate results of the presidential election; and a conspiracy against the rights of millions of Americans to vote and have their votes counted.” 

Upon the dropping of the filing, Trump campaign spokesman Steven Cheung immediately said that the release of the “falsehood-ridden, Unconstitutional J6 brief immediately following Tim Walz’s disastrous debate performance is another obvious attempt by the Harris-Biden regime to undermine American Democracy and interfere in this election.”

“Deranged Jack Smith and Washington DC Radical Democrats are hell-bent on weaponizing the Justice Department in an attempt to cling to power,” Cheung said. “President Trump is dominating, and the Radical Democrats throughout the Deep State are freaking out.”

Cheung added: “This entire case is a partisan, Unconstitutional Witch Hunt that should be dismissed entirely, together with ALL of the remaining Democrat hoaxes.”

    The author misses that Trump is a felon who sat for over three hours as the Capitol riot raged watching TV and doing nothing to protect and preserve his nation. He commands the largest military in the world and he did nothing. Friends, family, and associates called him and called upon him to do something and he did nothing for over 3 plus hours.

        Joe is correct in his own mind. It’s weird because:

        The video’s show he’s lying to himself. It’s an insurrection hidden inside a riot of rage hidden inside a peaceful protest inside an expressed mission from Trump: “You don’t concede when there’s theft involved. Our country has had enough. We will not take it anymore” and “if you don’t fight like hell you’re not going to have a country anymore.” The riot is as plain as the nose on his face on the video’s. The insurrection effort was proven, by the true facts, in court. And yes, the rally started as a peaceful protest.

        The 140 injured cops and the dead dumbass show he’s lying to himself.

        With over 1,200 arrests and over 890 convictions on federal crimes, sure seems that something was going on that Joe cannot understand as truth.

        The hundreds of 1/6/2021 convicts that blame Donald J. Trump is the extreme truth of the riot. Trump has not sued any of them as telling lies because the court heard their free speech where they blame Trump for what they did. Joe is living a delusion.

        Many of Trump’s associates, friends, and family saw a riot, called him, begged him to do something and he sat for over 3 hours watching on TV.

        More arrests for the riot are still ongoing. Joe still can’t see the truth.

        Ultimately someone called for support and they sure seemed to be quelling a riot.
