Biden’s Department of Justice (DOJ) has admitted to tampering with the evidence in the high-profile prosecution of President Trump over the alleged mishandling of classified documents. The revelation has turned the question around toward the DOJ as to who really has mishandled sensitive documents.
On Saturday (May 4), The Western Journal linked to a court filing dated May 3 and titled “Government’s Response to Defendant Waltine Nauta’s Motion to Extend Time” wherein Special Counsel Jack Smith admitted that his team changed the order of the documents in the boxes so that they do not match the scans that were made earlier. The story cited Smith’s prosecutors stating in the filing:
“There are some boxes where the order of items within that box is not the same as in the associated scans.”
In the said filing, a footnote reads what would amount to confession of misleading the court:
The Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court. (p 8)
This revelation amounts to direct admission of tampering with evidence, something not unexpected in the weaponized DOJ’s political witch-hunt of a case aiming to stop President Trump from the presidential race of 2024. Harvard Law Professor Emeritus Alan Dershowitz weighed in with his expert opinion:
“Prosecutors and investigators should never tamper with or alter evidence in their possession, including the order of documents in a box, because one never knows what may become relevant or crucial to a court or jury later in a case.”
Reacting to the bombshell confession of Smith, President Trump called for arresting Jack Smith, calling him a criminal.

Just the News reported that the House Judiciary Committee’s chairman, Congressman Jim Jordan, opened an investigation on Monday (May 6) into Smith’s handling of former President Donald Trump’s classified documents case. In a letter to DOJ’s counsel on the office of professional responsibility, Jordan demanded a briefing on what is being done to investigate Smith and his team. The letter also requested all documents and communications pertaining to the “manipulation of evidence in the Mar-a-Lago case.”
The DOJ has been provided with the deadline of May 20 to comply by the House Judiciary Committee’s request.
Seasoned journalist John Solomon of Just the News was interviewed on the conservative channel Real America’s Voice about the new court filing. Solomon commented that the revelation clearly admits to mishandling and violating the rules of evidence and as President Trump’s legal team pointed out, it is clearly a case of tampering with evidence.
