Kristen Clarke should be fired from DOJ for perjury
Kristen Clarke holds a high position in the Department of Justice. She is the Assistant Attorney General for Civil Rights. She was appointed to the post by President Biden. It is a position that requires Senate confirmation. She got it in 2021.
It was recently reported that Clarke had committed perjury during her Senate confirmation hearing – in writing and in testimony,
Arkansas Senator Tom Cotton posed this question to Clarke during the hearing. “Since becoming a legal adult, have you ever been arrested for or accused of committing a violent crime against any person?”
Clarke answered, “no.” in a similar written question as part of the vetting process, Clarke also answered “no.”
Weeell … It turns out that she was arrested and charged with “committing a violent crime against” another person. She was charged with “domestic violence” — specifically threatening her husband with a knife.
The case was dropped – an example of prosecutorial discretion, which raises questions about the rule-of-law when it comes to politically connected individuals. She subsequently filed an order to have both the court and police arrest records expunged. She got it. (I have worked with clients and friends on the issue of expungement and learned it is VERY difficult to get records expunged unless you have what is called “clout.”)
Clarke’s arrest was not due to youthful indiscretion, it occurred in 2006, when she was 31 years old, and the final expungement was granted in 2008.
Clarke’s arrest was reported in the press earlier this year. Initially, the Department of Justice ignored the reports and refused to comment. But the story spread, and a number of Senators who had voted for Clarke’s confirmation expressed their concerns.
That is when Clarke offered her explanation for lying to Congress in sworn testimony in an exclusive statement to CNN. She said she did not reveal her arrest because she was a victim of domestic abuse.
(Whoa! I guess if you cannot come up with good excuses for committing perjury, you have to come up with a bad one – and that is a very bad one. It makes no sense.)
CNN gave her sympathetic coverage, ignoring the foundational fact that she had committed perjury two times on a significant matter. The Network flipped off the matter as nothing more than a right-wing “pounce.”
The DOJ, itself, took up the irrational excuse, confirming that she did commit perjury, but it was understandable in view of the domestic abuse she suffered. There has not been a scintilla of evidence that she was a victim of domestic abuse – and her husband denies the accusations. The only fact we have to go on is that SHE was arrested and charged with domestic abuse – with a knife, no less.
We can recall that President Clinton escaped removal from office but was still held accountable in court for his perjury. He lost his law license over it.
Clarke was confirmed by the Senate despite a paper she wrote at Harvard suggesting that Blacks were superior to Whites physically and intellectually because of the melanin. She claimed that the paper was meant to be satirical. A later fact check by Newsweek did not find anything to suggest it was humorous. Clarke’s racist theory was subsequently supported by Harvard’s Black Students Association, which called for further investigation of it. Hardly the response to a joke.
Even if you disregard Clarke’s Harvard paper nothing more than the excesses of youth, perjury by an adult person in the legal profession being confirmed for a high-level job in the Department of Justice is more than enough reason to terminate Clarke. It is more likely, however, that the Clarke case will be another example of a two-tiered justice system when it comes to cases involving political left-wing Democrats.
So, there ‘tis.
I guess this comes down to what is the law and responsibility of someone with an expunged record to confess the record that does not exist as to actions that legally never happened. I just do not know, or care, frankly.

Frank, I did not rate this article because I do not know enough about Kristen Clarke.
A couple of things Larry wrote that are very interesting:
1) Larry’s view of women seems to be somewhat aligned with Trump. Clarke’s reason for the expunged event is domestic abuse. Larry’s response to Clarke’s reason is, “(Whoa! I guess if you cannot come up with good excuses for committing perjury, you have to come up with a bad one – and that is a very bad one. It makes no sense.)” Larry seems a bit clueless about women trapped in domestic abuse relationships. Many of them never report. And many who do report the abuse to the police often are arrested until they can figure out the facts of the situation. In this case, between 2003 and 2007, the police were called to the couple’s home seven times for domestic reasons. Most incidents were handled without a report – except for this one. So there is a report. Husband says he was running around with a girlfriend, wife caught him. A confrontation occurred. He was defending himself and his finger got in the way. 2) “Not a scintilla of evidence ….” I doubt seriously that Larry attempted to do an FOIA request for the police report. His scintilla detector must need new batteries. There is evidence but most likely Larry has not bothered much past a five minute google search. If the police were there seven times in five or so years, there was shit going on, and plenty of it. IF he wants to, her middle name is Marie, and she was born in 1975 which makes her 48-49 years of age. He denies any wrong doing in any of the calls to his home. He says she did time in jail. The record was not expunged until later, well before her 2021 appointment.
3) I get a kick out of these GOP MAGA types who want Clarke to resign for telling one lie while they support and praise Trump and want him at the top of the federal government despite his constant lying to the American voter, scamming judges, lying to his wife and girlfriends whom he cheats on his wife with, and now constantly lying about the affair with Stormy while all of the testimony and evidence says it happened. So fair is fair. I will agree to calling for Clarke’s resignation if MAGA agrees to calling for Trump’s resignation from the GOP.
My personal opinion which has been formed by reading this page, *https://www.findlaw.com/legalblogs/criminal-defense/when-must-you-disclose-an-expungement/* is that she should have answered that she had one expungement where she was involved in a domestic abuse altercation and should have described what the abuser was doing to her. I say this because the job she was applying for or being considered for by our lawfully elected president, Joe Biden, is one of the exceptions to the “no you do not have to report” rule. So Mr. Cotton’s questions were legal and in many federal jobs, required. She should have known this.

The only evidence of domestic abuse were the real charges against her. And even if she had been victimized, that is not a valid reason for committing perjury. That is what she did. I admit that it is a problem, in she said/he said cases, but if a spouse is to be convicted of abuse there damn well better be the type of evidence that will stand up in court. The ideal that any one should be believed in court without evidence or substantiation is contrary to the entire concept of American jurisprudence. The law bends in the favor of the defendant, not the prosecution. LOL At least you concede that she did commit perjury — and that her self-serving excuse does not hold up. Given her background, I have to assume she knowingly lied.
