Is Biden behind Trump’s court cases … as Trump says?
Whenever it is reported that President Trump accuses President Biden of being behind all those court cases as part of his political strategy, Democrats and their cronies in the press add the editorial caveat, “Of course, that is not true” as a matter of fact.
I have not seen any evidence that Biden has personally orchestrated the multi-pronged legal attack on Trump. So, I have to conclude that Biden is not directing it personally. But that leaves the question as to whether Biden is encouraging it or promoting it. Actually, he is, by pointing to Trump’s being tied up in court – jokingly, of course. But that is not wrong or unexpected. That is exactly what an opposing candidate would do.
So, there is no grand Democrat conspiracy to use – or abuse – the justice system to cripple Trump’s presidential campaign. Right? Maybe not.
The fact that Biden is not personally calling prosecutors to seek indictments against Trump, does not mean that there is not a broad conspiratorial strategy by Democrats in the justice system to pile on Trump as a campaign tactic.
We generally think of a conspiracy of a group of folks in a room plotting some sort of coordinated nefarious action. But there are different kinds of conspiracies – and not all are criminal. Some we call “strategic planning.” But not all require direct coordination. They are organic.
The latter is what I have called “conspiracies of self-interest.” Members of an interest group – like a political party – independently undertaking actions obviously beneficial to the cause. They operate independently, but with a common interest and a common goal. This may be what we see in the Trump case – or cases.
Are a number of seemingly unconnected prosecutors acting inappropriately with a common political interest? Are they abusing their power – bending the levers of justice to achieve partisan political advantage? From what we do know, it can be reasonably argued that the answer is “yes.”
What makes that answer interesting is to what extent did Trump’s actions, statements, questionable credibility and general pugnacity provide the fodder for a conspiracy of self-interest among Democrat prosecutors and judges. As President Nixon noted during the Watergate scandal that brought down his hither-to very popular presidency: “They stabbed us in the back, but we gave them the knife.”
What evidence is there to suggest a conspiracy of self-interest?
- First is the fact that in EVERY case, the prosecutor is a partisan Democrat office holder – mostly elected. If the rule-of-law were in effect, one would expect the party affiliation to be so dramatically one-sided.
- The number of cases being brought by Democrat prosecutors at the federal, state and even county levels is staggering. It looks like piling on. Often when a case involves both federal and state one yields to the other. Not in this case.
- Many of the cases seem overcharged. In New York, the case involves a misdemeanor campaign finance violation — for which the statute of limitation has passed – elevated to a felony. In Georgia, you have the casting of a wide net of indictments and using the RICO law – totally inappropriate for the alleged transgressions. Even the so-called Documents Case seems to be aggressively prosecuted – especially in view of the Justice Department’s total pass on similar “crimes” by President Biden and Vice President Pence. I have written in the past of my belief that the E. Jean Carroll case was pursued, decided and penalties set based less on facts and more on dislike of the defendant.
- It is not unreasonable to suggest political motivation based on the timing of the cases. Virtually all of the alleged “crimes” were committed years ago, and all the trials wind up within months of each other – and at the height of the campaign season.
- At the same time, the request for speedy trials seems to be politically motivated. Indictments and trials are never to be planned to impact on elections. Yet, prosecutors have been falling all over each other to get all the trials started and over in 2024 — prior to the election. These efforts fly in the face of judicial history that suggests a “normal” timeframe would have them all being resolved in 2025 or later. The only explanation for this last-minute rush-to-judgment is the election – and the fear that Trump will win. That may explain why the prosecutors were slow to bring charges in the first place — and now eager to adjudicate them at warp speed. It gives the appearance that it is all about influencing the election.
- And to some degree, there has been some level of coordination (conspiring?) among the prosecutors. They have talked to each other in some cases. And as widely reported in the media, there was an effort to coordinate the rollout of the cases for maximum impact on Trump and his campaign.
- In many cases against Trump and others associated with him, the indictments and the charges appear to be inconsistent and excessive to most similar cases.
The question is whether Trump is being treated fairly … without political bias or prosecutorial abuse. There is certainly enough there there to not dismiss that possibility out of hand. Much of the prosecution does not pass the smell test in my judgment.
To answer the headline question, I do not believe Biden is the master mind (no pun intended) behind the dizzying array of prosecutions, but he most certainly is the beneficiary.
(For those who are going to misrepresent this commentary as an exoneration of Trump and others, that is not what this commentary is about. This commentary is not about alleged crimes and culpability, but only to question whether the process is fair or politically motivated. That is the worthy question readers should decide for themselves.)

Or, like Horist, even something worse is happening because nothing is happening. Republicans like Horist do a lot of that: innuendo and rumor, McCarthyism investigations, trial by media in the court of public opinion, rarely get them into an actual court, much less win when they do. Or at least that’s what he says. Of course, what he says and what he thinks tend to differ. Excuse me: attack? Since when is following the law an “attack?” Gee, I got a speeding ticket in that legal “attack” speed trap at month’s end obviously targeting liberals because I live in a Red County. Or maybe I was just caught speeding because I was speeding.

At least not until King Don gets back on his throne. And there’s about a million other things it also does not mean —-ALL OF WHICH do not lead therefore to something else that it therefore does mean as Horist postulates here. One needs proof for meaning, not the absence of proof to create meaning. One thing does not necessarily suggest another. Nothing suggests even less. So Biden NOT personally calling prosecutors (which we all agree NO President should ever do), does not lead to a broad conspiracy and never will. Matter of fact, it leads nowhere.
Try: “The fact that Biden is not personally calling prosecutors to seek indictments against Trump, does not mean that” Trump did not do every single one of these crimes and millions more that he has not been indicted on yet just to bring in more donor money. Fact is we know he has made hundreds of millions because of the legal attack. Perhaps he planned it all just for the money.
Nope, that’s some failed logic, just like Horist’s.
Much weasel wording about the Horistian view of non-criminal conspiracies leading me to wonder if last night’s dinner collaboration was a Democratic conspiracy?

All self-respecting Americans hate Donald Trump and always have. You cite Democrats who are prosecuting him for his, frankly, stupid political maneuvers and business tactics, but the list of serious conservative Republicans who despise the man is like a who’s who in the Republican Party for thirty years: George W. Bush, Dick Cheney, Mitt Romney, to name three of the most prominent Republicans of the 21st Century. But look at all the Republicans who actually worked for him in his first failed administration who condemn him as incompetent now: John Bolton, H.R. Mac Masters, James Mattis, Rex Tillerson, John Kelly, all hand-picked by Trump for his cabinet, are outspoken in opposition to his ability to lead the country.
Biden doesn’t need any dirty tricks to induce more than half the country to hate Donald Trump. The question is, why would “the Grand Old Party,” the party of Lincoln, choose such a polarizing personality to lead them forward now? Even if he does squeak his way into the presidency for a second term, the effects on the country will be disastrous. A huge number of people will oppose every movie he makes. It was clear from his first term that he does not understand how to motivate Congress. He apparently thinks he’s running for king and does not understand the difference between a despotic ruler and a president. The reason a president was chosen to lead the US rather than a king, a czar, or and emperor, was exactly so despots cannot take hold. I concede that the modern Republican Party does not have much to offer in the way of leadership but persisting with Donald Trump does not just bode badly for the United States, based on his past performance it bodes badly for the entire world. What the hell are you doing?

Horist calls this a legal attack made stronger by Democratic prosecutors. Two of the judges are Republican, Horist does not mention that fact. The SCOTUS is a Trump court, Horist does not mention that fact. SCOTUS has already moved at light speed to help Trump in CO case, but is slow boating the DC case potentially moving the trial until after the election. This looks like Bush v Gore on steroids where the SCOTUS is trying to elect the next President, or King, if they rule in his favor. Trump has the best legal team his extreme money allows him to buy. His followers give him millions to defend himself. He has more money than the prosecution – Horist does not mention that.
Trump is allowed, verbally attack the judge, the jury, the court staff, the prosecution, all of their families, and he gets a slap on the wrist. He seems to treated much more “fairly” than you or I in this case. After a while, the judges still give him preferential treatment via weak gag orders that so far, Trump has violated without much recourse by the court. He’s getting a better deal than you or I would, for sure.

Biden has no need to press DOJ or force of law in pursuit of Trump’s plethora of illegalities still within the committed offenses time limitations. Trump proves his culpability in conspiring to break some law with each time he opens his mouth. He can’t help himself. He can’t keep all his lies lined up straight. The whole of this tale comes out of one person’s opinion and that being decidedly deep in partisan republican bunker territory. As that bias is fact in this case and information is generally known relative to Trump indictments but perceived from the Republican perspective. Whether or not Trump’s series of cases in the courts are being pursued fairly and judiciously from an objective guilty or innocent perspective does not depend on Biden’s opinion of Trump. It originates in one faith in the strength of our country’s judicial system. Opinions vary across a spectrum, low to high in confidence. Fact is, while a Democrat is in the WH Horist and his tribe line up on the skeptical red hued end of the spectrum. If a Republican happens to be POTUS, the jury is still out on the justice issue. Horist, like his so called conservative crowd, they keep a skeptic’s judgmental opinion regardless.
I, too, live and have resided my whole life in the company of Republican Party color bearers. All are unabashedly proud flag wavers and Trump 2020 bumper sticker loyalists.
Therefore, by brutal experience educated and learned from personal interactions, I do understand from a minority perspective of what Republicans’ opinions and conspiracy theories are made of.
Included in the demographic of my area (red swamp) are the Christian Nationalist brand in the Party. And, that strain of the GOP hold the prize for the most righteous pompous Constitutional ignorant individuals whomever walked on American soil.
