Court of Appeals No Blanket Immunity for Trump, What’s Next? 

In a devastating blow to the former president, The U.S. Court of Appeals has ruled that -Donald Trump is not immune from prosecution in the 2020 federal election case.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit rejected Trump’s claim he cannot be prosecuted because the allegations relate to his official responsibilities as president.

“We cannot accept that the office of the Presidency places its former occupants above the law for all time thereafter,” the unanimous panel wrote.

The court concluded that any executive immunity that may have shielded Trump from criminal charges while he served as president “no longer protects him against this prosecution.”

The ruling, which Trump vowed to appeal, rebuffs his attempt to avoid a trial on charges that he undermined American democracy and the transfer of power, even as he consolidates his position as the front-runner for the Republican presidential nomination.

Steven Cheung, Trump’s campaign spokesman, said the ruling “threatens the bedrock of our Republic.”

“If immunity is not granted to a President, every future President who leaves office will be immediately indicted by the opposing party. Without complete immunity, a President of the United States would not be able to properly function!” Cheung said in his statement.

The Trump campaign spokesperson added, “Deranged Jack Smith’s prosecution of President Trump for his Presidential, official acts is unconstitutional under the doctrine of Presidential Immunity and the Separation of Powers. Prosecuting a President for official acts violates the Constitution and threatens the bedrock of our Republic. President Trump respectfully disagrees with the D.C. Circuit’s decision and will appeal it in order to safeguard the Presidency and the Constitution.”

Special Counsel Jack Smith initially indicted Trump on Aug. 1, 2023. In the case, Trump said he had presidential immunity and that the case violated a double jeopardy clause because he was impeached by the U.S. House of Representatives over his alleged involvement. He was later acquitted after the U.S. Senate did not vote to convict him of the charge.

The two defenses were among four arguments Trump’s legal team pursued in arguing the court should reject the case.

In December 2023, U.S. District Judge Tanya Chutkan, who is presiding over the case, rejected Trump’s arguments, saying the office of the president “does not confer a lifelong ‘get-out-of-jail-free’ pass.”

Trump’s spokesman, Cheung, said Trump would appeal but did not say whether he would first ask the full D.C. Circuit Court to review the ruling or go directly to the U.S. Supreme Court.

A spokesperson for special counsel Jack Smith, who is leading the prosecution, declined to comment when asked by multiple news outlets. The case will remain paused until at least Feb. 12 to give Trump time to appeal to the U.S. Supreme Court.

      I think if this is enforced when the Republicans take back control of all three branches. There should be massive charges brought against the Kenyan Marxist Fairy Barry to answer for the bullshit he did that has put us on a path of destruction. Of course there are the charges for Biden and his whole criminal family enterprise for bribery and extortion and money laundering that should keep the Bidens busy covering their corrupt asses.. Also, Hillary Hag should have her criminal activities open to investigation of treason and corruption of the highest magnitude.

    Comparing Trump and the Magarats to the founding fathers and revolutionary patriots is just stupid. Not even close.

    The man stands accussed and will do anything to avoid testifying as to his actions in court, under oath, under pejury penalty.

    If he’s such a honest, strong, brave, patriot —– what’s his problem with telling the truth and being done with this once and for all time?

    He likes to “grab em by the pussy.” Guess he’s his own best friend. And only friend probably. Really — can you name a Trump friend that has not been found guilty of something?

No eye witnesses. No medical records. No law enforcement. Same with Tara Reade. No, I can’t prove her case either. But don’t worry. Trump will MAGA.     HB: Be a magarat, it is your right. While others suggest as you, you are choosing to not beleive what your eyes are telling you in futherance of your desire to be a magarate. And where you need to be careful, for God and country, is how you enable his actions, his defense, with yuor campaign dollars. That’s right, you pay to defend Don’s sexual abuse of a digital rape nature. It’s your money that allows this man to continue.

    First, what Biden does or did will never excuse Donald J. Trump or anyone else from what they did. It’s does not make it OK for others to do it, no matter who they are, but IMO, especially if they are our President, supposedly the best that we have for the job by electoral, and this time, by popular vote. And yes, I know you know, without proof, that he cheated but you just can’t catch him.

    Tara Reid also could not catch him. She cannot get funding to catch him. She cannot find a lawyer to help her catch him. Ask yourself: if Tara Reid could prove it in court, wouldn’t Trump, some rich magarat, or maybe a group of them, would take her case and fund her? Don’t you think Trump has investigated that? I mean some Repbulican convinced her to flee the country to stay alive —- as if Joe was going to kill her —- I mean I am pretty sure the Republicans know she is out there, they think she’s in danger, but they can’t get her to court? Your own eyes, man.

    Don was adjuticated in court. A jury of his peers heared EJ Carroll, heard the other women saying “yup, that’s what he does,” and all the other evidence and they concluded: “yup, he did it.” He got her alone, he slammed her against the wall, he pinned her, he reached up under her skirt, pulled down her tights, reached in her panties, and shoove his fingers into her vagina penetrating her for his pleasure. It’s in the court record, his defense failed. He can appeal the money but I doubt he will appeal the facts of the case. Your own eyes, man.

    Then the douchbag countersues her for defamation about calling him a rapist when he’s only a sexual abuser….. And the judge adds in: dude, any person in American would call you a rapist —- a digital rapist —- because you (see description above), yeah he said it, and then added “and only NY law that requires a penis to be present in the penetration saved you from that fate.

    Makes you wonder, did Don know NYS law that well before he did the dirty deed? I mean he does like to say how smart he is…….

    And the sexual abusing, digital rapist spent your money to defend against that. So, HB, it was proven in court by her testimony, witness testomony, and a lack of a reasonable defense to a jury of his peers. There will be an appeal, but it will be about the money and/or the law, not the facts of the case.

    The best part is he will have to pay ASAP, even before the appeal is done. I wonder if he can use your money for that? In which case, you will take more credit by funding Don’s sexual abuse escapades.
