<p>In the recent election, Californian Adam Schiff got himself promoted from the House of Representatives to the United States Senate. ; He is now facing the possibility of another venue change – federal prison. ; Unlikely, but possible. ; A criminal referral was sent to the DOJ in May, with the information made public in July.</p>



<p>It seems that Schiff <strong>may </strong>have (innocent until proven guilty) committed a series of frauds – including bank, mail and wire. ; At least that is what Williams Pulte, director of the Federal Housing Finance Agency, has sent a criminal referral to the Department of Justice. ; Pulte added that the Financial Crimes Division of Fannie Mae &#8220;concluded that Mr. Schiff has engaged in a sustained pattern of possible Mortgage Fraud&#8221; over a number of years.</p>



<p>According to Pulte, Schiff &#8220;has, in multiple instances, falsified bank documents and property records to acquire more favorable loan terms, impacting payments over a 16 year period, from 2003-2019, for a Potomac, Maryland-based property.&#8221; ; Specifically, Schiff is accused of falsely claiming his Maryland home was his primary residence in order to get a lower mortgage interest rate.</p>



<p>It is no small irony that Schiff is being pursued on charges that he and others have leveled at Trump for years. ; They are similar to charges which have New York Attorney General Letitia James under federal investigation – another rabid anti-Trump bloodhound. ; Unlike Trump, against whom James secured a civil liability verdict, she and Schiff are facing criminal charges. ;</p>



<p>Schiff is being accused on four counts &#8212; bank fraud, wire fraud, mail fraud and making false statements to a financial institution. ; If Schiff is indicted and convicted on the charges, the maximum sentence would be 20 years in a federal penitentiary. ; That is not going to happen, of course. ; As a first-time offender and a powerful senator – equally important considerations &#8212; Schiff is unlikely to spend more than a few weeks in the hoosegow, if at all.</p>



<p>&#8220;Mr. Schiff appears to have falsified records in order to receive favorable loan terms and also appears to have been aware of the financial benefits of a primary residence mortgage when compared to a secondary residence mortgage,&#8221; Pulte wrote in his criminal referral letter to the DOJ.</p>



<p>In 2009, 2011, 2012, and 2013, Schiff refinanced his Maryland home and listed it as his &#8220;principal residence.&#8221; ; Schiff simultaneously listed his California ;condo as his primary residence in separate financing documents &#8212; getting preferential treatment on both houses.</p>



<p>As a United States congressman, Schiff was required to have his official residence in California – although he is not required to reside within the Congressional District for which he served. ;</p>



<p>Trump jumped in, of course. ; Posting on his Truth Social platform, the President wrote:</p>



<p><em>“Adam Schiff said that his primary residence was in MARYLAND to get a cheaper mortgage and rip off America, when he must LIVE in CALIFORNIA because he was a Congressman from CALIFORNIA. ; I always knew Adam Schiff was a Crook.&#8221;</em></p>



<p>Schiff has been one of the most rabid anti-Trumpers in Congress. ; He was the Lead Impeachment Manager for the first Trump impeachment – and a ubiquitous anti-Trump guest on news programs – especially those leaning to the left. ;</p>



<p>Schiff got caught in a major lie involving accusations that Trump had conspired with Russia during the 2016 campaign. Schiff told reporters that as a member of the Intelligence Committee, he had seen hard evidence of the conspiracy – but could not reveal it at the time. ; Apparently, he was expecting Special Counsel Robert Mueller to justify the claim. ; However, Mueller’s report stated that no American – including Trump – had conspired with Russian interference. ; Schiff’s credibility regarding Trump was forever damaged &#8212; and he was initially called out for lying to the press. ; Since Schiff is a left-winger, the media dropped the story quickly.</p>



<p>Responding to the Criminal Referral, Schiff called it a “baseless attempt at political retribution by Trump” – and said the President is still upset that he (Schiff) had led the first impeachment against the president in 2019. It was a weak boilerplate comeback, to say the least.</p>



<p>Schiff’s problem is that in such cases, the paper record can be very convincing. ; He clearly misrepresented the truth on a number of Maryland mortgage applications – and clearly received the financial benefit over several years. Schiff can hardly plead innocence. ; Anyone with an IQ higher than a hockey score knows the financial benefits that accrue to a primary official residence and as opposed to a second home – especially a member of Congress. ; Schiff knew that he had to maintain his official residence in California.</p>



<p>So far, it is only a referral to the DOJ, but I am betting that they launch an investigation – with the odds favoring an indictment. ; After that, who knows?</p>
