ca lawmakers get inside your Bedroom with New Condom Law

California Governor Gavin Newsom (D) last week signed a first-of-its-kind law that makes it illegal to remove a condom during sex without your partner’s permission.

Supporters of the law say the act – known as “stealthing” – represents a violation in addition to the increased risk of unplanned pregnancy and sexually transmitted disease.

“The experience of realizing your partner, your sexual partner, has no concern for your autonomy, your individual dignity, your right to make decisions about who you can have sex with, when and how…that’s a terrible violation regardless of whether a physical injury occurs, regardless of whether a pregnancy occurs,” says California State Assemblymember Cristina Garcia (D), the bill’s sponsor. “I do hope that other states follow…I do hope that this elevates the discussion.” 

Rather than punish the person who removed the condom, the new law gives the “victim” legal grounds to sue. 

“Civil litigation keeps decision-making in the hands of survivors, which can be particularly important in the wake of sexual violence, which is itself a denial of the victim’s right to make decisions about their lives,” explains Alexandra Brodsky, a civil rights attorney whose 2017 law journal article on stealthing inspired Garcia to introduce the bill.

“There are a lot of survivors who don’t want to see the person who hurt them in prison but really could use some help rebuilding their lives, paying for mental health care, paying off medical debt, being able to take some time off from work in order to heal.”

>Wait, so I can take off work if someone removes a condom without my permission? Sounds like a great excuse to me!

Author’s Note: Not only is this law an extraordinarily inappropriate and unnecessary intrusion into the personal lives of Americans, but it is also proof that California lawmakers would rather pass nonsense legislation than address the numerous crises at hand.
