President Donald Trump has stated that he is “absolutely” thinking about breaking up the “outrageous” court that blocked his travel ban and his order to withhold federal funding from sanctuary cities.
On Friday, the 9th Circuit Court of Appeals refused to grant a request for an 11-member review of the President’s controversial travel ban, which was struck down by a federal judge earlier this year.
Trump criticized the court for failing to mention the travel ban’s language in their rejection. “The language on the ban, it reads so easily that a reasonably good student in the first grade will fully understand it.”
On Tuesday, a judge in San Francisco decided that Trump exceeded his authority with an order that sought to withhold federal money from sanctuary cities. The 9th Circuit has jurisdiction over that court.
Trump accuses his opponents of judge shopping. “Everybody immediately runs to the 9th Circuit. We have a big country. We have lots of other locations. But they immediately run to the 9th Circuit. Because they know that’s like, semi-automatic,” said Trump. “There are many people that want to break up the 9th Circuit. It’s outrageous.”
If Trump decides to move forward with his threat, he will have support from Republicans including Arizona Senator Jeff Flake, who expressed a similar opinion earlier this year. Along with fellow Arizona Senator John McCain, Flake proposed legislation to create a 12th Circuit with six states currently in the 9th Circuit.
The 9th Circuit is viewed as one of the most liberal courts in the country; 18 of its 25 judges were appointed by Democratic presidents. As Trump points out, the court has “close to an 80% reversal period…what’s going on in the 9th Circuit is a shame.”
The 9th Circuit oversees California, Nevada, Arizona, Alaska, Oregon, Nevada, Washington, Montana, and Hawaii – it also covers Guam and the Northern Mariana Islands.
Republicans rightly argue that the liberal court covers far too much territory. The 9th Circuit was created in 1891, when only 4% of the US population lived in the area. Today, 20% of our population lives in that area.
Meanwhile, the Trump Administration will continue to fight the court’s ruling.
“This is the Trump era. Progress is being made daily, and it will continue,” said AG Jeff Sessions. “This will be the administration that fully enforces our nation’s immigration laws.”
